BAG METRIX — Terms of Use

These Terms of Use (“Terms”) govern your use of the BAG METRIX mobile application (“App”).
By downloading, installing or using BAG METRIX, you agree to these Terms. If you do not agree with these Terms, do not use the App.
1. License
Subject to these Terms and any applicable App Store rules, you are granted a limited, non-exclusive, non-transferable and revocable license to use BAG METRIX for personal and lawful training and fitness purposes.
You may not copy, modify, distribute, sell, sublicense, reverse engineer or otherwise exploit the App except where such restriction is prohibited by applicable law.
2. Training and Safety
Boxing, martial arts, kicking, punching-bag training and other high-intensity physical activities involve inherent risks, including falls, collisions, muscle strain, joint injury and other physical injuries.
You are solely responsible for determining whether a training activity is appropriate for you.
Use appropriate protective equipment and follow safe training practices.
The smartphone or other device used with BAG METRIX must be securely attached or positioned according to the application’s instructions. Do not hold or attach an unsecured device in a manner that could cause it to strike you or another person.
Stop exercising if you experience pain, dizziness, unusual discomfort or other concerning symptoms and seek appropriate professional assistance when necessary.
3. Not Medical or Professional Advice
BAG METRIX is a sports-training and measurement tool.
The App is not a medical device and does not provide medical diagnosis, treatment, rehabilitation, injury assessment or medical advice.
Information, measurements and recommendations displayed by the App should not be treated as a substitute for advice from a qualified medical, fitness or sports professional.
4. Measurement Accuracy
BAG METRIX estimates training metrics using data obtained from compatible device sensors and mathematical models.
The displayed strike intensity, force index, direction, strike classification and other metrics are estimates and may be affected by:
device model and sensor characteristics;
device placement;
attachment method;
punching-bag construction;
bag weight, dimensions and filling material;
suspension type;
calibration and application settings;
environmental conditions;
sensor noise and other technical limitations.
The BAG METRIX force/intensity value is an analytical index and should not be interpreted as a certified physical-force measurement.
5. Device and Equipment Safety
You are responsible for using a compatible device and securing it properly during training.
BAG METRIX cannot guarantee that your device, mounting equipment, punching bag or other training equipment will remain undamaged during use.
To the maximum extent permitted by applicable law, BAG METRIX and its operator are not responsible for damage caused by improper installation, unsafe equipment, misuse of the App, or failure to follow safety instructions.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
6. Free and Pro Features
BAG METRIX may provide both free and paid functionality.
The available features may change as the application is updated.
The Free version may include basic workout recording and analysis with certain limits.
BAG METRIX Pro may provide additional functionality such as extended workout history, advanced analytics, additional bag profiles, advanced reports, export functionality and other professional features.
The current Pro features and applicable limits are displayed in the App before purchase.
7. Subscriptions
BAG METRIX Pro may be offered through auto-renewable subscriptions.
Current subscription plans may include:
Monthly subscription;
Annual subscription;
an introductory or free trial offer for eligible users.
The exact price, billing period, introductory offer and applicable currency are displayed by the App Store before purchase.
Subscriptions automatically renew unless cancelled in accordance with Apple’s subscription management procedures.
A subscription generally renews at the end of the current billing period unless cancelled at least 24 hours before the end of the current period, subject to Apple’s applicable subscription rules.
You can manage or cancel your subscription through your Apple Account subscription settings.
If you start a free trial or introductory offer, the subscription will convert to the applicable paid subscription unless cancelled before the trial or offer period ends, according to the terms displayed by Apple at the time of purchase.
Eligibility for introductory offers is determined by Apple and may depend on your previous subscription history.
8. Payments and Refunds
All payments for BAG METRIX Pro subscriptions are processed through Apple’s App Store.
BAG METRIX does not process or store your payment card information.
Requests for refunds or issues concerning an App Store purchase are handled according to Apple’s applicable policies and procedures.
9. Changes to Subscription Prices and Features
We may change subscription prices, subscription plans or Pro features in accordance with applicable law and Apple’s App Store rules.
Any applicable price change will be presented through the App Store according to Apple’s requirements.
We may add, modify or remove features as the App evolves.
10. Availability and Technical Limitations
BAG METRIX depends on compatible hardware, operating-system functionality and device sensors.
We do not guarantee that every feature will work on every device or operating-system version.
The App may occasionally be unavailable because of maintenance, operating-system changes, hardware limitations or circumstances outside our reasonable control.
11. Intellectual Property
BAG METRIX, including its software, design, branding, graphics, algorithms, interfaces and original content, is protected by applicable intellectual-property laws.
Except for the license expressly granted in these Terms, no ownership rights are transferred to you.
12. Termination
You may stop using BAG METRIX at any time by deleting the App.
Your license to use the App may terminate if you materially violate these Terms.
Termination does not affect rights or obligations that by their nature should survive termination, including applicable payment, intellectual-property, liability and dispute provisions.
13. Changes to These Terms
We may update these Terms when the App, subscription model, functionality or applicable legal requirements change.
The updated Terms will include a new effective date.
14. Governing Law
These Terms are subject to applicable law. Nothing in these Terms is intended to remove or restrict mandatory consumer rights available to you under the laws of your country or region.
